Application of the Residence Concept to the Eastern Mountain Avens (Geum peckii) in Canada [Proposed]-2006

Does the concept of residence under SARA apply to this species? No

(1) Does the ecology of the species include the use of a dwelling place--which is a specific location (or locations) or discrete spatial area that contains features similar to a den or nest, or performs functions similar to a den or nest?
No - the specific location occupied by an individual Eastern Mountain Avens plant is plainly a part of the general habitat of the species; there is no inherent feature of this area similar to a den or nest.

(2) Are these locations occupied or habitually occupied during all or part of the species’ life cycle?
NA

(3) Are these locations essential to the successful performance of a specific, crucial function of the species’ life-cycle?
NA

Individual Eastern Mountain Avens plants do not appear to use a dwelling place similar to a nest or den, and therefore do not qualify for having a residence. There would be no additional legal protection not already afforded by protection of the individual and its critical habitat.
